Ones who are obliged to register
Obligation to register chambers has been organized under the 9th Article of the Law numbered 5174.
In Accordance with this; Merchants registered to commerce registry and all legal entities having industrialist or marine merchant nature and branches and plants of these are obliged to register to chamber in their region according to 5th article. Member registrations to be done according to occupational groups are kept updated on a mutual database in electronic environment organized within the body of Ministry and Union.
Places or mercantile establishments within a working area whether a chamber of center or another chamber even though it is dependent upon a center, and that have independent capital and independent accounting and/or carrying out industrial and commercial activities even though their accounting is on center and they have no independent capital, are deemed as branch in terms of applying this Law.
In provinces where industrial chamber is established, industrialists meet the obligation of registering to chamber of commerce as well by registering into chamber of industry. Trade works that industrial enterprise owners are engaged in as part of their industrial works do not eliminate their industrialist qualifications; these can also get registered to chamber of commerce as well.
In case industrialist establish more than one mercantile establishment to sell their own industrial products, they are obliged to register to chamber of commerce and industry or chamber of commerce where salesrooms for more are involved and they are also obliged to register into chamber of commerce and industry of chamber of commerce in case they are engaged in commerce activities other than the sales of their own industrial products.
Financial enterprises whose all capital belongs to Government or local authorities or municipalities or associates of these and branches of these aforesaid enterprises are established with special law or agreements, Enterprises of legal entities that are associations of Government, local authorities or municipalities or branches or plants of these enterprises are obliged to register into chambers of the provinces they are involved in.
Marine merchants stated in the 5th article amongst the real and legal entities registered in commerce registry and the ones engaged in marine trade under the fifth clause are obliged to register to the chamber of shipping in the provinces they are involved in. The ones considered in this scope are deemed to have met the obligation of registering other chambers by registering into chamber of shipping. However, in case the ones in this scope are also engaged in other activities apart from activities requiring them to register into chamber of shipping, they are also obliged to register into the relevant chamber.
Real and legal entities obliged to register into chambers and branches of these entities shall not be obliged to register to other public occupational organizations, unions and institutions or pay subscription fees.
The ones who do not meet the registry obligation organized under this article are recorded as ex-officio by chambers and they are notified about the case.
